AI Deepfakes & POSH: Navigating the 2026 IT Rules and BNS Framework

The misuse of Artificial Intelligence (AI) to generate sexually explicit or harassing content is no longer a futuristic threat—it is a present-day legal reality. For employers and Internal Committees (IC), the rise of Synthetically Generated Information (SGI) introduces a complex breed of workplace disputes that challenge traditional notions of "evidence" and "misconduct."


AI deepfakes allow for the creation of derogatory images, videos, or audio recordings that are "indistinguishable from reality." These tools are frequently weaponised to target employees based on protected traits, such as gender or sexual orientation.


Recent litigation has highlighted a disturbing trend of "nudified" professional photos and AI-generated "intimate" videos circulated to humiliate victims. In these cases, the legal focus has shifted: the "falsity" of the media does not diminish the real-world trauma or the violation of an individual’s privacy and dignity.


The February 2026 IT Rules Amendment: A New Compliance Standard


The regulatory landscape in India reached a turning point with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2026. This amendment significantly raises the bar for how organisations and platforms must handle synthetic content.


Key highlights of the 2026 Amendment include:


  • The 2-Hour Takedown Mandate: Complaints involving non-consensual intimate or deepfake images must be acted upon within two hours. This is a critical window for ICs to coordinate with IT departments.


  • Mandatory Metadata & Labelling: AI-generated content must now carry permanent metadata. For an IC, this metadata serves as a digital "fingerprint" to track the origin of the harassment.


  • Transparency Requirements: Organisations are now obligated to proactively identify and label synthetic content on their internal networks.

The Role of the Internal Committee (IC) and Employer Liability


Under the POSH Act, 2013, an IC’s mandate is to ensure a safe workplace. Deepfakes create a "Hostile Work Environment" even if the physical office remains untouched.


  1. Hostile Work Environment: The circulation of a derogatory AI image among coworkers is a per se violation of Section 2(n) of the POSH Act. It affects the victim's ability to perform their job and their psychological well-being.


  2. Vicarious Liability: An employer or an IC can face liability not just for the creation of the content, but for procedural failure. If an organisation fails to act within the 2-hour window or lacks the tools to verify digital evidence, they risk a "patent breach of fundamental rights."


Judicial Precedents: Protecting Digital Modesty


The Indian judiciary has been proactive in shielding victims from AI misuse. In the landmark case of Kamya Buch vs. JIX5A & Ors (2025), the Delhi High Court described deepfake material as "appalling, deplorable, and a patent breach of fundamental rights." By granting an ad interim injunction to restrain the dissemination of such images, the Court signalled that the "Technology Defence" (claiming the image isn't real) is legally invalid. The focus remains on the impact on the aggrieved woman.


This shift is mirrored globally. In the landmark US appellate ruling Carranza v. City of Los Angeles (2026), a female Police Captain was awarded $4 million after an AI-generated sexually explicit image of her was circulated. Crucially, the court held the employer liable not for the creation of the image itself, but for the failure to take immediate and effective corrective action once notified.


Furthermore, the case of Pearson v. Washington State Patrol highlights that "Digital POSH" now extends beyond visual media to synthetic audio. In this matter, a supervisor used AI to clone a subordinate’s voice to simulate sexual acts, proving that AI-enabled hostile environments can lead to massive civil rights litigation and significant financial exposure.


Empowering the Internal Committee (IC): The Digital Transformation


In 2026, the definition of "workplace" has expanded into the digital ether. Under the February 2026 amendments to the IT Rules, Internal Committees have been granted unprecedented powers to act against digital misconduct. Passive neutrality is no longer an option; ICs must now function as tech-enabled investigative bodies.


1. Digital Forensics: Beyond the Screenshot


The modern IC can no longer rely on easily manipulated screenshots. "Digital IC" protocols are now the industry standard for verifying evidence.


  • Metadata Verification: ICs are now empowered to analyse metadata to confirm if a harassing file (AI or otherwise) was created on company hardware or during office hours. By tracing digital footprints, ICs can debunk the "I was hacked" or "It’s a deepfake" defence with technical certainty, ensuring inquiry reports are legally airtight and survive judicial scrutiny.

2. The "Hostile Environment" Shift: No Physicality Required


The 2026 legal landscape has officially retired the "physical contact" requirement for sexual harassment. Digital acts carry the same legal weight as physical ones.


  • The "Joke" Defence is Dead: Creating or circulating an AI-generated image of a colleague—even if intended as "office humour"—is strictly categorised as a Hostile Work Environment.


3. The BNS Nexus: From Policy Violation to Criminal Offence


For the first time, the findings of an IC are playing a pivotal role in the criminal justice system.


  • Evidence for Prosecution: Deepfakes are no longer just a policy breach; they are criminal acts. Under the BNS (Sections 77 & 78), an IC’s well-documented findings now serve as critical primary evidence in criminal investigations, shifting the resolution from the boardroom to the courtroom.
